Terms of service
I. Introduction
The following provisions (hereinafter, the “General Terms and Conditions”) govern the commercial relationships between V2 srl unipersonale (hereinafter, “V2”) and users of the e-shop store.v2brand.it (hereinafter, the “E-Shop”) for the purchase and sale of products offered through the E-Shop (hereinafter, the “Products”). Any contractual terms proposed by the User that derogate from the following General Terms and Conditions shall not apply unless V2 has expressly accepted them in writing. The relevant provisions of Legislative Decree No. 206/2005, the “Consumer Code”, pursuant to Article 7 of Law No. 229 of 29 July 2003, hereinafter referred to for brevity as the “Consumer Code”, shall also apply.
Under the following General Terms and Conditions, V2 may accept orders only from consumer Users with a valid residence and delivery address.
The description of the Products offered on the E-Shop is complete and exhaustive. V2 shall under no circumstances be liable for any differing product descriptions made available to the public by its employees or agents, or by third-party retailers.
V2 shall use its best efforts to ensure that the E-Shop service is not interrupted. Nevertheless, even with the utmost diligence, periods of downtime cannot be ruled out. V2 reserves the right to modify and suspend the service at any time.
The information contained on this website is subject to change by V2 and comprises only general information for the User’s use and benefit.
L’V2’s E-Shop and website use cookies to monitor user preferences. The privacy document contains further information on the use of cookies.
Neither V2 nor any third party guarantees the accuracy, completeness or currency of the information and material contained on the website. L’User acknowledges and accepts that the information and material contained on this website may contain inaccuracies and/or errors and, in this regard and to the extent permitted by applicable law, any liability of V2 for such inaccuracies and/or errors is expressly excluded.
L’s use of the information contained on this website is the sole responsibility of the User, and V2 shall in no event be liable for the User’s use of such information. Furthermore, the User is responsible for verifying that the services and products offered in the E-Shop are actually suitable and appropriate for the User’s needs, without this giving rise to any liability on the part of V2.
This website contains material that is owned by V2 or used under a specific license. Such material includes, by way of example and without limitation, the design, graphics and overall appearance of the website, and is protected by copyright and/or other intellectual property rights. Reproduction of the website is therefore prohibited.
L’Unauthorized use of this website may give rise to claims for damages and/or constitute a criminal offense.
This website may contain links to external websites. Such links are provided solely for the User’s convenience in order to provide the User with additional information. V2 accepts no responsibility for the content of external websites linked to its website store.v2italia.com. The mere inclusion of links does not imply recognition or approval by V2 of the linked websites or their content, for which the operators of the linked websites alone remain responsible.
II. Conclusion of the Contract
The User’s mere use of the E-Shop is not sufficient to conclude a contract between the User and V2 and therefore does not give rise to any contractual or non-contractual claims against V2.
The L’User must register on the website to access the E-Shop, providing a “username” and “password” (“Access Codes”). The User’s data is registered solely for the purpose of enabling V2 to manage the purchase procedure and related payment and does not constitute a final contact act. To register correctly, a “username” and password must be provided. The User is prohibited from entering false, and/or invented, and/or fictitious data during the registration procedure prior to using the E-Shop.
The L’User assumes responsibility for any activity carried out, including by third parties, through the use of their Access Codes and is required to promptly notify V2 of any breach or theft of their Access Codes by third parties.
The display of the Products in the E-Shop does not constitute a contractual offer by V2, but merely an invitation to make an offer. L’s order, submitted by the User by clicking the button labeled “complete order” in the “Proceed to Checkout” section (“Order”), constitutes a contractual offer to purchase. After receiving the Order from the User, V2 will send an email to the address provided by the User, confirming receipt of the Order and specifying the details of the Order (“Order Receipt Confirmation”). This Order Receipt Confirmation does not constitute acceptance of the User’s Order, but is solely intended to inform the User that V2 has duly received the Order. The sales contract between L’s User and V2 is concluded only when V2 informs the User by email that the Order has been accepted and that the Product has been shipped (“Shipping Confirmation”)
III. Right of withdrawal
Exercise of the right of withdrawal L’User may unilaterally cancel the order no later than 14 (fourteen) days from the date of receipt of the Product. Such cancellation must be made by: a) written notice sent to V2 by registered mail with return receipt within the above-mentioned period, or, alternatively, b) written notice sent to V2 by telegram, telex, fax or email within the above-mentioned period, provided that such notice is subsequently confirmed by registered mail with return receipt within the following 48 hours. If the Product has already been delivered, the User must return it within the aforementioned period and at their own expense, both for return procedures and exchange procedures. These General Terms and Conditions do not exclude the User’s obligation to preserve the Products after delivery and return them intact. The notice of Withdrawal and/or the returned Product must be sent to: address: V2 SRL - Strada Trossi 25, Verrone BI
Consequences of withdrawal Where the User validly exercises the right of withdrawal, V2 shall refund the price paid to the User within 30 (thirty) days of withdrawal. The period shall run from the date of receipt of the notice of withdrawal. The Products must be returned by postal parcel. If the Products are not returned, in whole or in part, or are returned damaged, V2 shall be entitled to claim compensation from the User for the damage suffered.
IV. Payment methods, prices and shipping costs
The prices shown in the E-Shop include VAT. The final price is the one indicated in the E-Shop at the time the order is placed. L’s VAT amount is specified separately in the accompanying invoice sent with the Product.
The cost of “Basic” shipping is borne by the User. The cost of “Express” shipping is borne by the User as specified on the E-Shop. The Product is delivered exclusively within the territories indicated above, and delivery to a post office box address is not available. As specified in Section I of these General Terms and Conditions, the Products presented on the E-Shop are intended exclusively for Users residing in the territory of the Republic of Italy who provide a delivery address within that territory. Users residing outside Italy must access the E-Shop through the specific section for their country of residence.
V2 has made reasonable efforts to process an Order within 4 (four) business days of receiving it. The courier service operates Monday through Friday from 9:00 a.m. to 5:00 p.m. LOrders received on Saturdays, Sundays or public holidays will be processed from the next business day. Except for unforeseen circumstances beyond V2’s control, the Product will be delivered to the User within 5 (five) days of being handed over to the courier. This delivery period is indicative only and is not binding. V2 accepts no liability for any loss or damage resulting from delivery delays. If delivery cannot be made to the delivery address specified by the User in the Order, a second delivery attempt will be made to the same address. If the courier is unable to deliver the Product on this second attempt either, the Product will be taken to the courier’s warehouse nearest the delivery address, and the User will be left a notice with the necessary collection instructions.
The Order must be paid for online by credit card (VISA, MASTER, AMEX).
V. Retention of title
Until the price and any other amount owed by the User to V2 have been paid in full, the delivered Product remains the property of V2, and the User may neither dispose of nor use it.
VI. Liability for defects
If the User considers that the Product does not conform to the Contract or is defective, they must promptly notify V2 through the relevant section of the E-Shop (“Dispute Form”), specifying the Product being disputed and the defects or non-conformities identified. The disputed Product must be returned to V2 together with a printout of the Dispute Form.
V2 will examine the Contested Product and notify the User by email whether or not they are entitled to a refund of the price or replacement of the Product. LAny refund will cover the purchase price paid by the User and any return costs. The refund or replacement will be made within 30 (thirty) days of the email notification by which V2 informs the User that they are entitled to a refund or replacement of the Product.
V2 shall not be liable for defects in the Products caused by delivery carried out by third parties, except as provided for in Article VII.
V2 shall not be liable for damages resulting from improper use of the Product, alteration thereof, normal wear and tear, or negligence in caring for the Product.
The foregoing in numbers 1, 2, 3 and 4 shall not prejudice the rights of the User under applicable laws.
VII. Liability for Breach of Contract
V2’s liability for breach of contract is limited to compensation for damages that are a direct consequence of the breach and, in any event, is limited to the price of the Product.
VIII. Non-Contractual Liability
In cases of wilful misconduct or gross negligence, V2 shall be liable in accordance with the law.
To the extent permitted by law, V2 shall in no event be liable for indirect damages caused by the Product delivered to the User (consequential losses), including, by way of example and without limitation, damage caused to other property.
Compensation for indirect damages and any other claim for damages against V2 that is not covered by Articles VII and VIII of these General Terms and Conditions is expressly excluded, except for liability imposed on V2 by law in cases of injury or death.
IX. Copyright and Trademarks
All content published on the website store.v2italia.com, including texts, documents, logos, images, graphics, videos, their arrangement and adaptations, is subject to intellectual property laws and protected by copyright. Copying, altering, translating, distributing, using, storing, or publishing this content on other websites without the prior written authorization of V2 is prohibited. Any content and contributions provided by third parties are identified as such.
Downloading, viewing, and printing the content of this website is permitted solely for personal use and does not confer on the user any rights or claims in respect of such material.
X. Final Provisions
Subject to the limitations provided by law, any claim by the User arising from a breach of contractual and/or other obligations by V2 is excluded in the event of force majeure, including, by way of example and without limitation, mobilization, war, riot and similar events such as fire, accidents, strikes, blockades or export restrictions, or other events in any case not attributable to V2.
V2’s failure to exercise any rights arising under these General Terms and Conditions shall not imply a waiver of such rights and shall not affect V2’s ability to exercise such rights subsequently. L’The User is therefore not released from their obligations to perform their obligations under these General Terms and Conditions promptly and in full.
Disputes arising from these General Terms and Conditions shall be subject to the jurisdiction of the courts of the User’s place of residence or, at the User’s choice or on the User’s initiative, to the jurisdiction of the Court of Bologna. If the User, contrary to the User’s statements during the order process, is not resident in the Republic of Italy, or if, after conclusion of the contract, the User moves their residence outside Italian territory, or if, at the time legal proceedings are brought against V2, the User’s exact residence is unknown, the court with jurisdiction over any dispute arising from or in connection with these General Terms and Conditions shall be Biella.
These General Terms and Conditions of Sale are governed by Italian law, including the Consumer Code and the E-Commerce law set out in Legislative Decree No. 70 of 9 April 2003. In all cases, this is without prejudice to rights provided for by mandatory provisions of the laws of the User’s country of residence.
The nullity or ineffectiveness of any of these clauses shall not result in the nullity or ineffectiveness of the General Terms and Conditions of Sale as a whole, which shall therefore remain fully effective and binding. The parties undertake to negotiate in good faith and replace any null or ineffective clauses with clauses that are not affected by nullity or ineffectiveness and whose content conforms to that of the previous clauses.
Amendments and additions to these General Terms and Conditions of Contract must be made in writing; communications and any statements relating to the contractual relationship must be made in writing and sent to V2’s address as indicated above and to the User’s address indicated for delivery of the Products.
